Guarantee conditions

In addition to the warranty rights which you as a consumer are granted by law in any case, we, the company Wentronic GmbH, grant a manufacturer’s guarantee for a limited period of time for a selection of our Goobay® products for quality and function under the following conditions:

For the purposes of this manufacturer’s warranty, “consumer” is any natural person who is the owner of a Goobay® product and has not purchased it in order to resell it or install it on the premises of a third party as part of his or her commercial independent professional activity.

1. Guarantee period and assertion of the guarantee
The warranty period applies from the date of your purchase of the Goobay® product as follows:

Batteries/accumulatorsWe can only guarantee that batteries/rechargeable batteries will maintain their capacity within the shelf life. Batteries and rechargeable batteries are considered to be consumables.
The warranty rights granted by law apply to the rest of the Goobay® product range.

To claim the warranty, please contact us using the options listed below. Our competent staff will record your problem and coordinate the further procedure with you. In the event of a return, please use the original packaging if possible to avoid transport damage.

The proof of purchase (receipt/invoice) is required to claim under the warranty. Please keep this as proof of purchase.

2. Territorial scope of the guarantee

The warranty applies to our Goobay® products in the following countries:
EU, UK and Switzerland

3. Nature and scope of the guarantee

The type of warranty service is carried out at our discretion either by free repair or free delivery of a replacement for the Goobay® product in question (in the event of unavailability, e.g. due to a product change, we will deliver a replacement of equal value or higher that looks and functions as similar as possible. Furthermore, we reserve the right to adapt the warranty service to technical progress).

The scope of the warranty does not cover defects and damage due to improper use, wear parts and consumables. Improper use includes in particular:
• a use deviating from the specifications in the instruction manual (if no instruction manual is available, any use not in accordance with the intended purpose or unusual use is considered improper)
• failure to observe the safety instructions in the user manual/operating instructions or on the packaging
• water and fall damage as well as damage due to dirt
• technical interventions carried out by yourself or by third parties, such as dismantling, modification or alteration
• improper storage
• improper installation
• normal wear and tear (e.g. scratches) and changes to the surface/colour due to use

The warranty does not apply to exhibits or factory seconds

If Wentronic discovers during an inspection of the Goobay® product that the fault/defect in question does not entitle the consumer to assert warranty claims, Wentronic reserves the right to charge the consumer for any costs of the inspection. Wentronic does not assume any transport costs and risks.

Damage which has not occurred to the Goobay® product itself is also not covered by the guarantee. Consequently, claims for damages of any kind, in particular for breach of duty and for tort, as well as claims for compensation for expenditure against us and against our vicarious agents and assistants are excluded within the scope of the guarantee; this also applies to claims for compensation for consequential damage caused by defects. Further claims do not arise within the scope of the guarantee.

The above-mentioned restrictions do not apply to statutory rights to which the end customer (consumer) is entitled from a purchase of consumer goods or, in general, to the buyer from injury to life, body or health or due to intent or gross negligence or from the Product Liability Act (ProdHaftG).

A performance on the basis of the guarantee does not cause an extension of the guarantee period, nor does it initiate a new guarantee.

4. Expiry of the guarantee

After the warranty period has expired, you also have the possibility to contact our service hotline.
However, repairs after the warranty period are subject to a charge and are not included in the warranty.

5. No exclusion of the statutory warranty rights / information in case of warranty promises (§ 477 BGB):

The statutory warranty rights are not limited by this guarantee, but are also available to the purchaser in full and unchanged.

Regardless of this manufacturer’s warranty and of whether or not the prescribed warranty is invoked in a warranty case, the legal warranty rights against the seller exist without restriction. At his own free choice, the legally regulated buyer’s rights due to defects of the purchased goods – in particular subsequent performance, withdrawal, reduction of the purchase price or compensation for damages (see § 437 BGB and the corresponding special statute of limitations in § 438 BGB) – can therefore be asserted against the seller in addition to or even without asserting the warranty claims.

6. Consumer information on out-of-court online dispute resolution and the consumer conciliation body

If and insofar as manufacturer guarantee contracts arise between us, Wentronic GmbH, and consumers, we are obliged to provide the following information:

• The European Commission provides a platform (so-called OS platform) for the extrajudicial online settlement of disputes, which you can find at https://ec.europa.eu/consumers/odr.

• In the area of manufacturer warranty contracts, we are obliged and willing to participate in dispute resolution proceedings before a consumer arbitration board. *On 02.03.2017, the ECJ (Case No. 568/15) issued a decision on the interpretation of the term “basic tariff” and determined that the costs of a call under a service number set up by a business in relation to a concluded consumer contract may not exceed the costs of a call under a normal geographical fixed network number or a mobile phone number. After reinsurance with our service provider, all our contracts have been checked for this regulation and comply with the legal requirements. Should you be charged higher costs again, we would ask you to contact us. We will of course reimburse you for any additional costs.
